These Terms of Use (“Terms”) constitute a legal agreement between you and GET FUND CAPITAL (“GET FUND CAPITAL,” “we”, “us”, “our” and related variations). By accessing any part of this Site (“Site”) or by using the Services (described below), you are bound by these Terms, the GET FUND CAPITAL Privacy Policy (available on the Site), and any other legal terms set forth on the Site (collectively, “Terms”). Certain Services may require you to accept additional terms.

GET FUND CAPITAL helps qualified small business owners find business financing solutions through its network of approved lenders and finance providers. GET FUND CAPITAL is not a lender or finance provider and does not underwrite, approve, fund or collect on loans or other financial solutions.

As with any legal obligation, you are urged to read and understand these Terms and any other legal documents presented to you through the Service.

“Service” means the products, services and software you access or utilize, including any activity GET FUND CAPITAL undertakes to connect you to potential lenders or finance providers.

“Account” refers to your registration with GET FUND CAPITAL and any information you voluntarily provide to GET FUND CAPITAL; “Account” in this context does not refer to any banking or financial accounts.

The words “include,” “includes” and “including” are to be read as if they were followed by the phrase “without limitation.”

Changes to These Terms

We reserve the right to change, modify, add or remove portions of these Terms at any time without prior notice to you. Your continued use of the Site following posting changes means you accept and agree to the changes. The last revision date is listed at the top of the Terms. Please check these Terms periodically for changes.

Content

GET FUND CAPITAL owns or has permission to use all text, graphics, user interfaces, visual interfaces, photographs, trademarks (registered or unregistered), logos, sounds, artwork of any kind, and computer code (collectively, “Content”). Content includes without limitation the design, structure, coordination, selection, appearance, and arrangement of such Content.

Your misuse of such Content may violate trade dress, copyright, trademark, and other intellectual property laws and unfair competition laws.

Use of GET FUND CAPITAL’s Site and Service

By using the Site or Services, you agree to the following:

User-Generated Content or Information Submissions

You are solely responsible for, and assume all liability regarding:
(i) information and content you provide through your use of the Site and Services,
(ii) your interaction with any third parties, and
(iii) your decision to accept any loan or financial service provided by a third party.

You understand and acknowledge that GET FUND CAPITAL is not responsible for the accuracy of information you or other users provide.

Assumption of Risk; No Guarantees

You assume all risk when using the Service and interacting with third parties. GET FUND CAPITAL does not guarantee that you will be connected with a lender or obtain financing.

Truthful Information

You agree to provide accurate, current, and complete information that belongs to you. You may not use the Site or Services on behalf of another person or business.

Prohibited Uses

You agree not to use the Site:

In violation of any applicable law or regulation

To transmit false, misleading, or unauthorized information

To send spam or unsolicited communications

To impersonate GET FUND CAPITAL or any other person or entity

To interfere with the proper functioning of the Site

(Technical misuse, malware, scraping, denial-of-service attacks, and unauthorized access are strictly prohibited.)

E-Sign & Application Authorization

By using our e-sign/click-to-sign functionality, each business and business owner/officer (collectively, the “Applicant”) certifies that they are authorized to submit this application on behalf of the named business.

Applicant authorizes GET FUND CAPITAL LLC (“GFC”) to:

Share application data with lenders, funders, successors, assigns, and designees

Obtain consumer, business, and investigative reports (including hard credit pulls)

Contact Applicant via email, SMS, and phone (including autodialed calls), even if listed on Do-Not-Call registries

This authorization is valid for 120 days unless revoked in writing.

FCRA Consent

Pursuant to the Fair Credit Reporting Act, Applicant authorizes GET FUND CAPITAL and its agents to obtain consumer and investigative consumer reports, including but not limited to credit history, criminal records, employment history, education, and public records, for purposes related to financing, verification, fraud prevention, or related lawful business purposes.

License to Use Your Content

By submitting information to GET FUND CAPITAL, you grant an irrevocable, perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute such information in connection with the Services.

Information Security & Disclosures

GET FUND CAPITAL may disclose information if required by law or necessary to protect its rights, users, or property. While we implement reasonable security measures, no system is 100% secure.

Third-Party Links & Disclaimers

GET FUND CAPITAL is not responsible for third-party websites, lenders, advertisers, or their content. Any dealings with third parties are solely between you and them.

Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GET FUND CAPITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES.

Indemnification

You agree to indemnify and hold harmless GET FUND CAPITAL and its affiliates from any claims arising out of your use of the Site or violation of these Terms.

Term and Termination

These Terms remain in effect until terminated. GET FUND CAPITAL may suspend or terminate access at any time, with or without notice.

Access to Bank Records

GET FUND CAPITAL may use Plaid Technologies, Inc. or similar providers to access banking data for verification, fraud prevention, and related purposes.

Governing Law, Arbitration & Class Action Waiver

These Terms are governed by the laws of California. Any disputes shall be resolved by binding arbitration (AAA or JAMS, California).
Class actions are expressly waived.

Any claim must be filed within one (1) year of accrual.
